The following are the general conditions that regulate access, navigation and use of the web pages under the domain of Horos Asset Management, as well as the liability arising from the use of their contents.

It is presumed that the access or mere use of www.horosam.com by the User implies the latter’s adherence to the general conditions that Horos Asset Management has published at each time when accessing its website. Consequently, the User must be aware of these general conditions. In this sense, the User shall be understood as the person who accesses, navigates, uses or participates in the services and activities, free or paid, developed in Horos Asset Management.

The purpose of these general conditions is to regulate access, navigation and use of www.horosam.com.

Horos Asset Management, as the author of a collective work, is the owner of the intellectual and industrial property exploitation rights of www.horosam.com, and is also the owner or has the corresponding license for the intellectual, industrial and image property rights of the content available through said website.

Under no circumstances shall it be understood that the User’s access and navigation implies a waiver, transmission, license or total or partial transfer of said rights by Horos Asset Management.

Acceptance of these general conditions implies the exclusive transfer by the User of any intellectual or industrial property exploitation rights that the User may hold over the communications that he/she makes through www.horosam.com.

Horos Asset Management does not guarantee the reliability, usefulness or accuracy of the services or information provided through www.horosam.com.

Consequently, Horos Asset Management does not guarantee or accept responsibility for: i) The continuity of the contents of www.horosam.com; ii) The absence of errors in said contents or the correction of any defect that may occur; iii) The absence of viruses and/or other harmful components in www.horosam.com or in the server that supplies it; iv) The invulnerability of www.horosam.com and/or the impregnability of the security measures adopted therein; v) The lack of usefulness or performance of the contents of www.horosam.com; vi) The damages or losses caused, to itself or to a third party, by any person who infringes the conditions, rules and instructions that Horos Asset Management establishes in www.horosam.com or through the violation of any of the terms and conditions established by Horos Asset Management … the security systems of www.horosam.com. The temporary validity of these general conditions therefore coincides with the time of their display, until they are modified in whole or in part, at which time the modified general conditions will become effective.

Notwithstanding the provisions of the specific conditions, Horos Asset Management may terminate, suspend or interrupt, at any time and without prior notice, access to the contents of the page, without the possibility for the User to demand any compensation. After such termination, the prohibitions on the use of the contents set forth above in the general conditions will remain in force.

The headings of the different clauses are for information purposes only, and will not affect, qualify or expand the interpretation of the general conditions.

In the event of a discrepancy between the provisions of these general conditions and the specific conditions of each specific service, the provisions of the latter shall prevail.

In the event that any provision or provisions of these general conditions were considered null or inapplicable, in whole or in part, by any competent Court, Tribunal or administrative body, said nullity or inapplicability shall not affect the other provisions of the general conditions or the specific conditions of the different Horos Asset Management services.

The non-exercise or execution by Horos Asset Management of any right or provision contained in these general conditions shall not constitute a waiver thereof, unless acknowledged and agreed in writing by it.

The relations established between Horos Asset Management and the User shall be governed by the provisions of current regulations regarding applicable legislation and competent jurisdiction. However, for cases in which the regulations provide the possibility for the parties to submit to a jurisdiction, Horos Asset Management and the User, expressly waiving any other jurisdiction that may apply to them, submit to the Courts and Tribunals of the city of Madrid, Spain.
